  • Essay / the legislative branch - 1220

The most powerful branch of government is the legislative branch. The Constitution separates the powers of the United States government into three divisions known as the executive, judicial, and legislative branches. The powers of each branch are constantly regulated by a system of checks and balances. The system ensures that no branch becomes stronger than the other. However, the Constitution lists eighteen enumerated powers granted only to Congress. The Constitution grants more powers to Congress than any other branch, giving it an unfair advantage over the process of equalizing checks and balances. The legislative branch is stronger than its counterparts because it has the power to legislate, override executive vetoes, and impeach federal officials. The power of Congress to create laws strengthens legislative power by giving Congress the power to regulate that influences structural power relations. United States Government. the Judiciary Act of 1789 established the order of three types of federal courts within the judiciary; where the highest court is the Supreme Court, the circuit courts and, at the base, the district courts. The creation of the Judiciary Act demonstrates Congress's power over the structure of the federal courts that make up the judicial branch. Although the Constitution established the Supreme Court as the highest judicial court in the United States, Congress has the power to create lower courts, as confirmed by the Judiciary Act of 1789, giving Congress great influence over the functioning of the judiciary. The Civil Rights Act passed by Congress in 1964 prohibits segregation in public places, businesses, and requires integration...... middle of paper...... and scales. The power of Congress to legislate impacts how and which laws are enforced by the executive branch and interpreted by the judicial branch. Through a ⅔ majority vote to pass a vetoed bill, Congress is able to exert its regulatory effect regardless of the disapproval of a presidential veto. More power is given to Congress because the power of impeachment gives Congress the ability to remove federal officers, including the president himself, from office, thereby limiting the powers of federal officers under threat of impeachment. Despite the system of checks and balances intended to distribute power equitably among the three branches, the Legislative Branch is able to use the powers granted to it by the Constitution to effectively create regulations that influence the systemic structures of state government -United so that they work in its favor..
